Negligence and Medical Malpractice in the HealthCare Industry

November 22, 2011 @ 01:45 PM — by Zach Drivon

The Professionals'

Doctors, Surgeons, and Physicians alike, represent a class of the most well respected, prestigious, and indeed well compensated professions in our society. The role they have taken on as healers is of the utmost importance and responisbility. Their counsel is sought after in order to maximize the individual capacity to live healthy, happy and productive lives. As patients, and laypersons, we are inclined to defer to the medical expertise they are presumed to possess, as it relates to our medical care. However, medical professionals carry a heavy burden; which is the duty to adhere to a reasonable standard of care. Injuries to patients which occur as a result of a medical professional's failure to adhere to this standard may carry substantial civil liability, for which compensation may be due. These failures in medicine constitute a type of professional negligence known as medical malpractice.

Childhood Sexual Abuse

It is startling to think of childhood sexual abuse as a problem which is widespread and rampant in our society; but in fact, the statistics support this morbid proposition. According to the national child abuse and neglect data system, in 2003, there were 78,188 reported cases of childhood sexual abuse.http://www.fosteringperspectives.org/fp_v10n2/stats.htm  (Douglas & Finkelhor, 2005) Although teens are at a higher risk, children of all ages are potential victims. A compounding factor to this problem is that these crimes often go unreported. The subjects of this deplorable behavior are victimized not only by the abuse itself, but also by the concealment of the abuse by individuals who were aware of it, but failed to hold the perpetrators accountable. The partners at Drivon, Turner and Waters believe that victims of past childhood sexual abuse may be entitled to civil remedy

Introduction:

There are countless factors which may contribute to the risk of being involved in a traffic collission. Some of these factors include poor road conditions, unforseen debris, faulty vehicle design or repair, or unsafe driving practices, like speeding, talking on a cell phone, failure to yield, disregard of traffic signals, and driving while intoxicated. The resulting motor vehicle injuries are often directly attributable to a drivers failure to exercise reasonable care to avoid unreasonable risks of harm, otherwise known as negligence. Such injuries may cause the victim to incurr expenisve medical bills, lost wages, and significant pain and suffering, for which compensation may be due. The most severe injuries are frequently suffered by pedestrians who are struck by vehicleshttp://www.kcra.com/news/29571711/detail.html
