Hazardous conditions during holiday travel increases risk of injury to drivers.

Holiday Hazards

Poor weather conditions, anxious, inattentive, and inebriated drivers, along with a substantial increase in traffic volume during the holidays, all combine to make holiday travel a dangerous proposition. According to the C.H.P, four people were killed over the Christmas holiday weekend last year, in which 658 drivers were also arrested for DUI.http://www.chp.ca.gov/pdf/media/11-39.pdf  Only one week later, during the new years weekend, 25 people were killed and astoundingly, 961 drivers were arrested for DUI. Injuries resulting from Dangerous Conditions on Public or Private Property may be Compensable

Premises Liability

Generally, owners or possessors of land (landholders) are responsible for injuries suffered by others on the premises, which are caused by willful negligent acts of the landholder, or by the landholders failure to exercise ordinary care or skill in the management of his or her property. Depending on the legal classification of the injured party, which is based primarily on the nature of the business or activity being conducted, landholders incur a duty of care that is owed to those who enter onto the land. A violation, or failure to adhere to this duty of care which results in injuries to persons on the land, may create liability in the landholder for which an injured party may be compensated.
