As the summer heat sets in, millions of Americans will be flocking to local neighborhood pools, whether they be at a public park or private residence. Swimming and sunbathing are a staple of summertime recreation, and a cherished pass-time which allows us to get a little exercise while having a great time. However, it is a grim reality that every year thousands of Americans are seriously injured or killed in drowning incidents. Even more disturbing is the fact that most of these incidents could have been avoided. Drownings which occur as a result of some act or omission may be attributable to negligence

 

Pharmaceutical Drug Lawsuits

Prescription Drugs are a part of every day life, and it is no surprise that some also have negative side effects. The give and take of this dynamic, is that the benefit provided by the drug will hopefully outweigh any detrimental effect it may have. Unfortunately, consumers may unwittingly subject themselves to severe risks, as manufacturers do not always provide full disclosure with respect to internal studies of extended use. The Food and Drug Administration (FDA) is the entity responsible for approving these drugs for the market. However, it is not always fully appraised of the severity of the inherent risk associated with certain drugs during the approval process.  This non-disclosure by manufacturers can cost lives, and may constitute negligence for which injured users may be entitled to compensation.

Alcohol consumption has been a common form of communal socialization from the time of our country's inception, and indeed for thousands of years prior. However, the detrimental effects of consumption often outweigh any social (let alone health) benefits, in decreasing inhibitions, increasing compulsive behavior, and causing individuals to lose control of themselves. One of the ways in which the ills of consumption manifests itself, is when an intoxicated person chooses to get behind the wheel of a car. Despite a broad awareness of the danger of drunk driving, as well as hefty fines, and criminal penalties for repeated offenses, studies show that one person dies in a drunk driving collision every 50 minutes. http://www.madd.org/statistics/ Drunk driving is prevalent across the country, and constitutes an absolute violation of a persons duty to exercise reasonable care in the operation of their vehicle, otherwise known as negligence.

18-Wheel Tractor Trailers, commonly referred to as 'Big Rigs' are as common to highways as the pavement upon which we travel. They serve as indispensable utilities of commerce, delivering the commodities which fuel our daily lives, and provide a convenience of accessibility that we treasure as part of our American culture. Despite the invaluable service these vehicular monsters facilitate, they present a grave danger to vehicles which cross their path. The scale of big-rig-tractor-trailers is enough to naturally pose a threat to smaller, more vulnerable vehicles on the highway. Moreover, truck drivers can also contribute to the risk of collision through unsafe driving practices or habitual inattentiveness.

Several times a year, news stories in the media alert the public to product recalls'. Recalls' occur when the government, product manufacturers or retailers determine that a particular product line is unsafe. Unfortunately, this determination is often made after someone is injured as a result of the defect. Other times, companies simply neglect to disclose the existence of a defect in the product, allowing consumers without knowledge of its existence to be injured as a result. Doctors, Surgeons, and Physicians alike, represent a class of the most well respected, prestigious, and indeed well compensated professions in our society.The role they have taken on as healers is of the utmost importance and responisbility. Their counsel is sought after in order to maximize the individual capacity to live healthy, happy and productive lives. As patients, and laypersons, we are inclined to defer to the medical expertise they are presumed to possess, as it relates to our medical care. However, medical professionals carry a heavy burden; which is the duty to adhere to a reasonable standard of care. Injuries to patients which occur as a result of a medical professional's failure to adhere to this standard may carry substantial civil liability, for which compensation may be due. These failures in medicine constitute a type of professional negligence known as medical malpractice.
